EVENTO SIOI – Ocean Commons – Common Heritage, Marine Genetic Resources and Biodiversity Conservation in Areas beyond National Jurisdiction

The workshop titled «Ocean Commons: Common Heritage, Marine Genetic Resources, and Biodiversity Conservation in Areas beyond National Jurisdiction», intends to debate some of the key questions being raised and discussed within the context of the ongoing preparatory committee of the United Nations tasked with delivering a draft text containing elements for an international legally-binding instrument under the United Nations Conventions for the Law of the Sea on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction.
One of the key points under discussion hinges on the legal status of marine genetic resources in marine areas beyond national jurisdiction, and especially in the Area, including, importantly, a legal regime for the access and the equitable sharing of benefits arising from their commercial utilization. Questions of environmental protection, distributional justice and economic opportunities intersect sometimes in conflictual ways. This workshop intends to highlight and explore some of these questions, directly, or through comparative and theoretical reflections. Presentations, held by experts in the field, will both contribute to the advancement of the academic debate and provide useful input to the ongoing negotiations.
This workshop is jointly organized by the K.G. Jebsen Centre for the Law of the Sea (JCLOS), UiT Arctic University of Norway, and the Institute for International Legal Studies (ISGI), National Research Council of Italy. The workshop is convened by Dr. Vito De Lucia (JCLOS) and Dr. Gemma Andreone (ISGI/CNR).

Il workshop “Ocean Commons: Common Heritage, Marine Genetic Resources, and Biodiversity Conservation in Areas beyond National Jurisdiction” si occupa di alcune questioni centrali nel dibattito in corso in seno al comitato preparatorio delle Nazioni Unite che ha ricevuto mandato di proporre una bozza di accordo internazionale sulla conservazione e uso sostenibile della biodiversità marina in aree fuori della giurisdizione statale. Questo accordo dovrebbe dare applicazione e integrare le disposizioni della Convenzione internazionale sul diritto del mare del 1982 in materia di protezione della biodiversità in alto mare.
Uno degli aspetti principali concerne il regime giuridico delle risorse marine genetiche in aree al di fuori della giurisdizione statale, e specialmente nell’Area, incluso il regime di accesso e condivisione dei benefici derivanti dal loro utilizzo. Regimi di regolamentazione e libertà, e questioni di protezione ambientale, conservazione delle biodiversità marina, giustizia distributiva ed opportunità commerciali si intersecano e talvolta si sovrappongono. Il workshop intende contribuire all’avanzamento del dibattito accademico in materia, nonché offrire spunti di analisi e differenti prospettive ai policy-makers e agli stakeholders.
Il workshop è organizzato congiuntamente dal Dr. Vit De Lucia, K. G. Jebsen Centre for the Law of the Sea (JCLOS) della UiT Arctic University of Norway e dal Dr. Gemma Andreone, Istituto di Studi Giuridici Internazionali (ISGI) del Consiglio Nazionale delle Ricerche.
